Throughout the site, the terms “we”, “us” and “our” can refer to either of our brands, Dietlicious or Gourmet Dinner Service. Gourmet Dinner Service Australia PTY LTD (GDS) offers this website, including all information, tools and services available from this website and any (information, tools and services including but not Limited to): newsletters, social media, images, menus, emails, offers, adverts, orders, text messages, online chats and telephone calls to or from you, the user (or your representative), conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site, contacting us and/or purchasing meals from us, you or your representative/s engage in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content, as well as those who place orders via email and telephone.
Please read these Terms and Conditions carefully before ordering from us, accessing or using our website. By ordering from us, accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions.
Any new features or tools which are added to the current store shall also be subject to the Terms and Conditions. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. By agreeing to these Terms and Conditions, you represent that you are at least the age of majority or that you are the age of majority in your state of residence, and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
By ordering via our site, it is your responsibility to ensure the information you provide is current, up to date and all relevant fields are completed. In some circumstances for us to successfully process your order, we may require you to verify information or provide additional information, instructions, or details.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
SECTION 4 - SITE CONTENT AND INFORMATION PROVIDED
The material on this site, as well as information provided via email, telephone, social media, advertising and other marketing sources, is for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. For example, any nutrition information is not medical advice, it is of a general nature only and you need to seek advice from your general practitioner or seek a referral to an Accredited Practising Dietitian for nutrition advice specific to your needs.
No information provided by Gourmet Dinner Service or Dietlicious is medical advice, diagnosis or treatment plan. We do not assume any liability for the content of any material provided by Gourmet Dinner Service or Dietlicious or our affiliated partners or companies. We recommend you consult your general practitioner or other suitably qualified health professional before commencing any new diet or eating plan.
From time to time we update recipes, may change suppliers of fresh produce or alter ingredients in our meals due to seasonality or availability. Additionally, batch cooking naturally produces non-identical output causing small disparities to occur with weight and nutritional values. Whilst we make every effort to ensure consistency and accuracy of website and product label information, occasionally there may be a discrepancy. This may be due to product changes being made, timing of website updates, stock held in different locations, human error or for other reasons. Where there is a discrepancy between website and label information, the label is correct for the contents therein.
SECTION 5 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to modify or discontinue any product or service at any time, without notice. Any offer for any product or service made on this site is void where prohibited.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 6 – PRODUCT VARIATION AND REPRESENTATION
Our meals are made by hand so there can be small changes from batch to batch. Whilst we aim to minimise this through clear processes and procedures, changes may occur due to the quality and variability of fresh produce from season to season.
We have made every effort to display as accurately as possible the colours and quality of our food that appear on the site, in our menus, advertising and social media. We cannot guarantee that your printer or your computer monitor's display of any colour will be an accurate representation of our products.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 7 – FEES AND CHARGES
By ordering on gourmetdinnerservice.com.au and/or dietlicious.com.au you agree to pay the following fees and charges:
- The stated purchase price of products added to your cart, note minimum orders sizes must be met for order to be accepted and delivered
- The delivery fee which may vary depending on your delivery postcode
- GST, as applied where applicable
- Any other fees and charges which may apply to your order but will be stated at the checkout before payment is made
SECTION 8 – PAYMENT
We accept Visa debit & credit cards, Master Card debit &credit cards, Amex, Google pay, Apple pay and PayPal. Your card will be charged in advance for the full value of the total order. Your order is only confirmed when you receive both an order confirmation and a payment confirmation.
We reserve the right to amend or refuse the sale, if the payment is not received prior to delivery day. Please note that prices may alter, and that we reserve the right to change prices without prior notice.
We offer payment terms to registered NDIS and HCP registered providers, by prior arrangement and after approval.
SECTION 9 - REFUND and RETURN POLICY
We are unable to accept returns as we are governed by HACCP food safety practices and procedures. Gourmet Dinner Service and Dietlicious do not provide refunds for change of mind or if you simply do not like a product. However, if you receive a product that is not what you ordered or arrived damaged during delivery, please contact us within 8 hours of delivery with supporting photos to make arrangement for a return or replacement. Gourmet Dinner Service or Dietlicious will decide the best option for each individual case. We reserve the right to refuse a refund or replacement if we believe the case is not genuine or breaches our policy.
SECTION 10 - MISSING OR REPLACEMENT ITEMS
Whilst we aim to keep very accurate stock records to minimise out of stock events, due to unforeseen circumstances or human error, out of stock items may occur at short notice. In the event of this occurring, we will provide you with a substitute product at equal or greater value or another meal you have selected as part of your order. No additional cost will be incurred.
If an item is missing from your delivery, you must contact us at [email protected] or [email protected] as soon as possible so we can check your order and the relevant packaging details in our records to rectify the situation. If we agree the item was missing, we will discuss options with you. This may include providing a credit for your next order of equal or greater value to the missing item, arranging for the item/s to the redelivered or refunding the value of the missing item – including any discounts which were applied to the order. The decision rests with Gourmet Dinner Service and Dietlicious to determine to best course of action for each order.
SECTION 11 – CANCELLATION OF ORDER
Gourmet Dinner Service and Dietlicious may cancel all or part of an order even once processed, without any liability due to errors on the website. This may be related to the ingredients, pricing, human error, product availability or any other reason. You will be notified via email, phone or text message depending on availability and issue at the time.
The customer may cancel an order 5 business days prior to the nominated delivery date. If you have a change in plans, a delivery may be postponed to a new date at no extra cost if done within 5 business days. On some occasions we may be able to be flexible with shorter notification and will work with you to find a solution to a delivery challenge. However, we will not accept responsibility of short notice change of plans (less than 5 days).
SECTION 12 – DELIVERY SERVICE
Gourmet Dinner Service and Dietlicious will only fulfill orders which are ordered online or via our Customer Service team by phone or email. These deliveries will be made to postcodes within our delivery scope as specified at the time of ordering. You will also be required to choose a delivery day and provide any special delivery instructions which will be shared with the delivery driver or courier delivery provider. The onus is on the individual making the order to accurately declare the correct address, delivery postcode, delivery date and delivery instructions.
We aim to meet your expectation and deliver the product in the specified delivery time, date and location however there are circumstances outside our reasonable control that may hinder, delay or cancel an order. We will not be liable for these delays and will do what we can to notify you of these occurrences as soon as possible and attempt to rectify the situation.
Should there be no person in attendance to accept the delivery and if no special delivery instructions are provided, the meals will be left at the nominated address and where the delivery driver deems appropriate at the time of delivery. Gourmet Dinner Service and Dietlicious does not accept any responsibility for stolen, damaged or lost items delivered on behalf of Gourmet Dinner Service and Dietlicious to the nominated address.
Theft of a Gourmet Dinner Service or Dietlicious order from the delivery address shall not be deemed as the fault of either the appointed Courier or Gourmet Dinner Service Australia Pty Limited. Should theft occur at a delivery address, we reserve the right to suspend your deliveries until further notice or until satisfactory arrangements have been finalised for a safe delivery.
SECTION 13 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that, we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made on our online stores or by email or telephone. You agree to promptly update your account and other information, including your email address, delivery address, mobile phone number and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You also agree to provide accurate delivery instructions when ordering to avoid mis-deliveries. The onus is on you to provide this information so it can be communicated to the delivery driver.
SECTION 14 - FOOD ALLERGY & INTOLERANCE DISCLAIMER
Gourmet Dinner Service and Dietlicious takes food handling, labelling, safety, allergies and intolerances very seriously. Gourmet Dinner Service and Dietlicious also attempts to provide accurate nutrition information for our products. Gourmet Dinner Service and Dietlicious use a number of products in our kitchen which many people are allergic to and may be at risk of cross contamination. Customers with food allergies and intolerances need to read the nutrition and ingredients information carefully and consumption of these meals is at their own risk. Gourmet Dinner Service and Dietlicious are HACPP certified and follow all steps mandated under HACPP requirements.
Seeds, nut shells, bones, olive pits and other by products
Gourmet Dinner Service Australia Pty Ltd purchases food ingredients and packaging from a variety of suppliers. For example, these include items like pre-pitted olives, shelled or ground nuts, whole fish with bones or pre-washed fresh salad leave and fresh herbs, along with many other items. Whilst our chefs endeavour to look out for items such as bones in pre-boned meats, pits in pre-pitted olives, nut shells, fish bones in fish or grit in fresh herbs to double check the removal of these items as purchased. You acknowledge that whilst we make our best efforts to ensure our products are free of any foreign objects, natural products may contain hard or sharp natural components such as bones and scales in seafood, shell in nut products and pips in fruit products.
SECTION 16 - GIFT VOUCHERS
Gift vouchers are available for purchase online or by telephone and can be redeemed online at gourmetdinnerservice.com.au and/or dietlicious.com.au or via telephone. For additional items not covered by the cost of the gift voucher, this must be paid at the time of purchase.
Gift vouchers will be issued with a 3 year expiry date from date of purchase. Failure to use the voucher in the given time will result in the gift voucher being void.
SECTION 17 - PROMOTIONS, DISCOUNTS, FREE PRODUCTS AND CUSTOMER OFFERS
From time to time, Gourmet Dinner Service and Dietlicious may run promotions via, email, social media and advertising. These may include, but are not limited to discounts, promotions, free products, competitions, special offers and other marketing events. Such promotions and offers are at the discretion of Gourmet Dinner Service or Dietlicious and we have the right to change or withdraw them at any time, without notice. They are offered in good faith and are subject to the Terms and Conditions, along with any specially noted terms and conditions applicable to that promotion or offer.
Where a promotional code is required to obtain the discount, offer or free product, the onus is on the customer to apply the relevant promotional code at the time of order, at the checkout or over the phone. Once the order has been processed by our site or by our Customer Service team, the promotional code cannot be applied retrospectively.
Only one promotional code may be applied per order and promotional codes cannot be used in conjunction with any other offers or discounts.
Gourmet Dinner Service and Dietlicious reserve the right to refuse a promotional code that is not used in accordance with the conditions outlined or with the intended purpose of one promotion per order. Promotional items, for example meals, cannot be swapped for other items or redeemed for cash or credit.
SECTION 18 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools, ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions.

Certain content, products and services available via our Service may include materials from third parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.

We welcome your feedback about our meals and our entire service. All feedback is taken seriously, and we will use customers feedback to help us improve or make changes to our offering. If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.

You agree to indemnify, defend and hold harmless Gourmet Dinner Service Australia Pty Ltd along with Dietlicious, any subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 25 - SEVERABILITY
In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 27 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).SECTION 28 - ENTIRE AGREEMENT

SECTION 31 - FORCE MAJEURE
Gourmet Dinner Service and Dietlicious is not responsible for any delay, damage, or failure to deliver goods caused by a Forced Majeure event. This is any act of god, nature or other elements, terrorism, piracy, civil war, insurrection, revolution or civil strife, acts of public enemies, federal or state laws. This also includes the inability to procure material, equipment or labour required to service our products. We will not be liable for any other causes beyond the control of Gourmet Dinner Service and Dietlicious and will not be considered a breach of or failure to perform under this Agreement.
SECTION 32 - NDIS CODE OF CONDUCT
GOURMET DINNER SERVICE and DIETLICIOUS and its staff members are committed to following the NDIS Code of Conduct to:
- Act with respect for individual rights to freedom of expression, self-determination and decision-making in accordance with applicable laws and conventions.
- Respect the privacy of people with disability.
- Provide supports and services in a safe and competent manner, with care and skill.
- Act with integrity, honesty and transparency.
- Promptly take steps to raise and act on concerns about matters that may impact the quality and safety of supports and services provided to people with disability.
- Take all reasonable steps to prevent and respond to all forms of violence against and exploitation, neglect and abuse of people with disability.
- Take all reasonable steps to prevent and respond to sexual misconduct.
SECTION 33 - GOURMET DINNER SERVICE AND DIETLICIOUS CUSTOMER LOYALTY PROGRAM
Loyalty Program is not functioning at present due to changes in the program. Points are still accruing and the program should be active in February.

By registering as a user of the Website, you are automatically eligible for the Program.

We may vary these Loyalty Terms at any time, without notice, by displaying the amended Loyalty Terms on the Website. You should review the Loyalty Terms each time you use the Website. - Earning Loyalty points
Loyalty Points are earned on the customer account where the activity has taken place (associated with a particular customer email address).
3.1 If customers hold more than one account or separate accounts with our two websites, Gourmet Dinner Service and Dietlicious, points are earned per account.
3.2 Loyalty points cannot be transferred between accounts, for the removal of doubt this means if you have two accounts with us you cannot transfer points from one account to the other. Points need to be used on the account the points are earned.
3.3 To earn points, you must be logged into your account when you place an order. If you use the guest checkout then points will not be accrued and cannot be added to your account later.
3.4 Loyalty Points are not earned on promotional items or discounts. You will earn Loyalty Points on the total amount of money spent with us.
3.5 You can earn Loyalty Points on the purchase of a gift voucher but not on the redemption of a gift voucher.
3.6 Loyalty Points for Refer a Friend are earned for new customer referrals only. To qualify, the email address referred must not already be held within our email or ordering system.
3.7 Loyalty Points for Refer a Friend are earned where a new customer has spent $100 or more on food – exclusive of delivery fees, promotional items or discounts.
3.8 Loyalty Points for Refer a Friend referrals are only earned once the friend has purchased with us and the delivery has been shipped.
3.9 Loyalty points for Refer a Friend will be automatically added to the referring customer’s account once criteria are met. The referring customer will earn 2500 points (equivalent to $25) to redeem against a future order. - Redemption of Loyalty Points
4.1 Redemption of Loyalty Points into Store Credit can be done in increments of up to $50 value.
4.2 Loyalty Points and Refer a Friend codes will only be valid for use in delivery areas that we service.
4.3 All Loyalty Points held within a customer account will expire after a period of 12 months of account inactivity. That is, where no Loyalty Points have been earned in the previous 12 months.
4.4 Loyalty Point redemptions to Store Credit is in Australian currency only. - Other Terms
5.1 Loyalty Points and/or Store Credit on a customer account is not transferrable or redeemable for cash.
5.2 Gourmet Dinner Service/Dietlicious has the right to modify or terminate the Loyalty Program at any time without notice.
5.3 points cannot be transferred, exchanged or redeemed for cash.
5.4 We may offer other benefits as part of the Program from time to time. Such benefits may be subject to their own specific terms and conditions (e.g. redemption conditions).
5.5 We are not responsible for any tax implications that arise from any User participating in the Program.
5.6 These Terms are governed by the laws of New South Wales, Australia.
